Carer’s leave certificate online

If you need time off to care for a sick or injured family or household member, your employer can ask for evidence. What is a carer’s certificate?

A carer’s certificate (sometimes called a carer’s leave certificate or carer’s medical certificate) is evidence that you needed to care for or support someone because they were sick, injured or affected by an unexpected emergency. Employers can ask for it when you take carer’s leave, in the same way they can ask for a medical certificate when you take sick leave.

Who counts as family or household?

Under the National Employment Standards, you can take carer’s leave for a member of your immediate family or household:

  • your spouse or de facto partner, including a former spouse or partner
  • your child, parent, grandparent, grandchild or sibling
  • those same relatives of your spouse or de facto partner
  • step and adoptive relations
  • anyone who lives with you

How much carer’s leave do you get?

Sick leave and carer’s leave come from the same balance, often called personal/carer’s leave. Full-time employees accrue 10 days a year, and part-time employees accrue a pro-rata amount based on their ordinary hours. Unused leave carries over from year to year.

If your paid balance runs out, or you’re a casual employee, you can take 2 days of unpaid carer’s leave each time someone in your immediate family or household needs care.

What evidence can your employer ask for?

You need to tell your employer as soon as possible, which can be after the leave has started, and say how long you expect to be away. Your employer can then ask for evidence, even for a single day. The Fair Work Ombudsman says the evidence must convince a reasonable person that you genuinely needed the leave, and lists medical certificates and statutory declarations as examples.

An award or registered agreement can set out when evidence is needed and what type, as long as the type requested is reasonable in the circumstances.

Who can I take carer’s leave for?

An immediate family member or a member of your household who is sick, injured or affected by an unexpected emergency. Immediate family includes a spouse or de facto partner (current or former), child, parent, grandparent, grandchild or sibling, and those relatives of your spouse or partner, including step and adoptive relations. A household member is anyone who lives with you.

Does the certificate say what’s wrong with the person I’m caring for?

No. A carer’s certificate confirms that you needed to provide care or support and the dates involved. It doesn’t need to include the other person’s private medical details.

Can my employer ask for a certificate for one day of carer’s leave?

Yes. The Fair Work Ombudsman says employers can ask for evidence for as little as one day, or less, off work. The evidence must convince a reasonable person that you were entitled to the leave.

I’m a casual employee. Am I entitled to carer’s leave?

Casual employees aren’t entitled to paid carer’s leave, but they can take 2 days of unpaid carer’s leave each time an immediate family or household member needs care because of illness, injury or an unexpected emergency. Full-time and part-time employees can take unpaid carer’s leave once their paid balance has run out.

Is a statutory declaration enough instead?

Sometimes. The Fair Work Ombudsman lists medical certificates and statutory declarations as examples of acceptable evidence, but your award or registered agreement can say which type you need. Check before you choose.

How much does it cost and how long does it take?

$35 flat, whether the certificate covers one day or several, and the request is assessed typically within 48 hours. A certificate is issued only when the practitioner considers it clinically appropriate.
